Terms of Service

Effective November 6, 2026

The short version

  • You need to be at least 13 (16 in the EEA and UK) to use the service.
  • Generations cost credits. Daily free credits reset every day, plan credits reset each billing period, pack credits never expire.
  • A job that fails returns its reserved credits automatically.
  • Subscriptions renew until you cancel. Cancelling stops the next charge; you keep your plan until the period ends.
  • Don't generate sexual content, content involving minors, or anything illegal, and don't abuse the free tier or the API.
  • What you can do with your sprites is set out in the Commercial License.

These Terms of Service (“Terms”) govern your use of aispritemaker.com, its web app, free browser tools, REST API, MCP server and any related software (together, the “Service”). The Service is operated by AI Sprite Maker (“we”, “us”). By creating an account or using the Service you agree to these Terms. If you are using the Service for a company or team, you confirm you are allowed to accept these Terms on its behalf.

Related documents that form part of these Terms: the Privacy Policy, the Refund Policy and the Commercial License.

1. Who can use the Service

  • You must be at least 13 years old. If you live in the European Economic Area or the United Kingdom you must be at least 16, or have permission from a parent or guardian where local law allows it.
  • You must give accurate sign-up information and keep your login secure. You are responsible for what happens under your account and your API keys.
  • One person, one free account. Creating multiple accounts to collect free credits is not allowed.

2. The free browser tools

Tools under /tools (for example the video to sprite sheet converter, sprite sheet slicer and palette swapper) run in your browser. Files you open in them are processed on your device and are not uploaded to us. They are free, need no account, and you may use their output for any purpose, including commercial projects.

3. Credits

AI generation (sprites, animations, directions, tilesets, edits, custom motions and video cleanup) costs credits. The current cost of each action is listed on the pricing page and in the API reference, and the generator shows the cost before you start a job.

  • Daily free credits are granted to signed-in accounts every day, are valid until 00:00 UTC, and do not accumulate.
  • Sign-up credits are a one-time grant to new accounts.
  • Plan credits are granted at the start of each billing period of a paid subscription and expire at the end of that period. Annual plans grant credits monthly.
  • Pack credits are bought one time and never expire while your account exists.
  • When you start a job we reserve the maximum it can cost. When it finishes we charge what it actually used and release the rest. If a job fails or is cancelled before producing output, the reserved credits are released in full.
  • Credits are spent in this order: daily, plan, sign-up and promotional, then pack credits.
  • Credits have no cash value, cannot be transferred between accounts, and are not refundable except as described in the Refund Policy.

4. Subscriptions, payment and taxes

  • Paid plans (Starter, Pro and Studio) are billed monthly or yearly in advance. Prices are shown in US dollars on the pricing page.
  • Payments are processed by Stripe. We do not see or store your full card number.
  • Taxes such as VAT, GST or US sales tax are calculated by Stripe Tax based on your location and added at checkout where they apply.
  • Subscriptions renew automatically at the end of each period until you cancel. You can cancel at any time from your dashboard (Billing, which opens the Stripe customer portal). Cancelling stops future charges. Your plan and its remaining credits stay active until the end of the period you already paid for.
  • If you upgrade mid-period, Stripe charges a prorated difference and the new plan’s credits apply right away. Downgrades take effect at the next renewal.
  • If a renewal payment fails, Stripe retries it. If it still fails your account moves to the Free plan; pack credits you bought are kept.
  • We may change prices. Changes to an existing subscription take effect at your next renewal, and we will email you at least 30 days before. Credit costs per action may change with notice on the pricing page and changelog; jobs already started are charged at the price shown when they started.

5. Your content

“Inputs” are the prompts, reference images, videos and other material you submit. “Outputs” are the sprites, sheets, frames and files the Service generates for you.

  • You keep whatever rights you have in your Inputs. You confirm you have the right to use them and that they do not infringe anyone else’s rights.
  • You give us a limited licence to store, process and transmit your Inputs and Outputs only to run the Service for you: generating, moderating, storing, showing them in your dashboard, and delivering them through the API. We do not use your Inputs or Outputs to train our own AI models.
  • If you choose to publish an Output to the public gallery, you also allow us to display it there, with its prompt, until you unpublish it.
  • Your rights in Outputs, which are the same on every plan, are described in the Commercial License.
  • AI output can be similar or identical to output produced for someone else. Outputs are not exclusive to you.

6. Acceptable use

You must not use the Service to:

  • create sexual or sexually suggestive content, or any content involving minors in a sexual, violent or exploitative way;
  • create content that is illegal where you live, that harasses or threatens a real person, or that depicts a real person without their consent;
  • infringe copyrights, trademarks or other rights, or present Outputs as official assets of a brand or franchise you do not own;
  • generate malware, spam or content designed to deceive people (for example fake product listings or impersonation);
  • get around credit limits, rate limits or plan restrictions, collect free credits with multiple accounts, or resell or share access to your account or API keys;
  • attack, overload, scrape or reverse-engineer the Service, or probe it for vulnerabilities without our written permission (if you find a security issue, email us and we will work with you).

Prompts and Outputs are checked by automated moderation. A job that is blocked by moderation is stopped and its credits are released. We may remove content, suspend API keys or close accounts that break these rules. Where an account is closed for serious or repeated abuse, unused credits are forfeited.

7. API and MCP server

  • API and MCP access is included with every plan, including Free. It uses the same credit balance as the web app.
  • Keep your API keys secret. Treat them like passwords. You are responsible for charges made with your keys until you revoke them in the dashboard.
  • Rate and concurrency limits per plan are published in the API documentation. Requests above the limits are rejected with an error, not charged.
  • We aim to keep the API stable. Breaking changes are announced in the changelog and we keep the old behaviour available for at least 90 days where we reasonably can.
  • You may build products on top of the API, including tools you offer to your own users, as long as those users also follow Section 6.

8. Availability and changes to the Service

We work hard to keep the Service running, but it is provided without a guaranteed uptime commitment. AI providers we rely on can be slow or unavailable; when that happens we may route your job to another provider or fail it and release its credits. We may add, change or remove features. If we remove a paid feature you rely on, contact us and we will offer a fair remedy, such as a prorated refund.

9. Ending your account

You can ask us to delete your account at any time (see how to delete your account). Deletion cancels any subscription and removes your data as described in the Privacy Policy. Unused credits are lost on deletion. We may suspend or end your access if you break these Terms, if required by law, or if we stop offering the Service; if we end the Service entirely we will give at least 30 days’ notice and refund unused prepaid subscription time.

10. Disclaimers

The Service and its Outputs are provided “as is”. We do not promise that Outputs will be free of errors, suitable for a specific purpose, or free of resemblance to existing works, characters or trademarks. You are responsible for checking Outputs before you publish or sell anything that uses them. Nothing in these Terms limits rights you have under consumer protection laws that cannot be waived.

11. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and 50 US dollars. These limits do not apply to liability that cannot be limited by law, such as for fraud or for death or personal injury caused by negligence.

12. Indemnity

If you use the Service for a business, you agree to cover our reasonable costs from third-party claims caused by your Inputs, your use of Outputs, or your breach of these Terms.

If you believe content on the Service infringes your copyright, email hello@aispritemaker.com with: your contact details, the work you own, the URL or asset ID of the content, a statement that you believe in good faith the use is not authorised, and a statement, under penalty of perjury, that your notice is accurate and you are the owner or authorised to act for the owner. We respond to valid notices and remove infringing content. Repeat infringers lose their accounts.

14. Changes to these Terms

We may update these Terms. For material changes we will email account holders and show a notice in the app at least 14 days before they take effect. The date at the top of this page shows when the current version took effect. If you keep using the Service after a change takes effect, the new Terms apply.

15. Governing law and disputes

These Terms are governed by the laws of the place where the operator of AI Sprite Maker is established, without regard to its conflict-of-law rules. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and may bring claims in your local courts. Before filing any claim, please email us; most problems are solved faster that way.
